A Philippine Food and Drug Administration (FDA) License to Operate (LTO) is an authorization for establishments that perform FDA-regulated activities involving health products. The FDA eServices Portal currently provides LTO application paths for several establishment and product categories, including food, drug, device, bottled water, iodized salt, household/urban hazardous substances (HUHS), and other supported activities.

The exact requirements are not identical for every business. A food trader, drugstore, medical-device distributor, manufacturer, and other regulated establishment can have different qualified-personnel, facility, documentary, or inspection requirements. Use this guide to understand the common online flow, then follow the checklist shown for your exact establishment type in the official FDA system.

Before you start

  • Identify the exact regulated activity of the establishment: manufacturer, trader, distributor, importer, exporter, wholesaler, retailer, outlet, or another FDA-regulated activity.
  • Check whether that establishment type is currently available in the FDA eServices LTO section.
  • Prepare an email address that the authorized person or qualified personnel can reliably access. FDA application notices, verification codes, payment instructions, and results may be sent electronically.
  • Prepare the legal and establishment information requested by the specific eServices form. The online form itself shows the documentary requirements for the selected category.

Step 1: Open the official FDA eServices Portal

Go to FDA eServices, choose Applications, then select License to Operate. Choose the product or establishment category that matches the business.

The FDA eServices FAQ states that a user account is not required for the public application flow. Do not use unofficial websites that ask you to surrender credentials or pay a private “FDA processing” charge.

Step 2: Choose the correct application type

Depending on the establishment category, the portal may offer:

  • Initial — for a new LTO.
  • Renewal — for an existing LTO that is due for renewal.
  • Variation — for an approved establishment that needs to report or apply for a permitted change.
  • Compliance or document submission — where enabled for the selected establishment type.

Do not use a renewal application to hide a change that should be filed as a variation. The declaration in the FDA system requires accurate and up-to-date establishment information.

Step 3: Complete the online form and upload requirements

The fields depend on the selected activity. For example, the current food-trader initial application includes sections for the declaration and undertaking, general information, establishment information, office and warehouse addresses, authorized officer, qualified personnel, documentary requirements, and a self-assessment review.

Use clear, readable files and make sure names, addresses, business details, and personnel information are consistent across the supporting documents. Uploading an incomplete, expired, unreadable, or inconsistent document can result in a compliance request or disapproval.

Step 4: Submit for FDA pre-assessment

After submission, FDA conducts a pre-assessment of the online application and supporting documents. According to the FDA eServices FAQ, an acceptable application may be followed by an Order of Payment sent to the registered email address when payment is required.

Fees depend on the authorization and establishment category. Use the amount and account details shown in the official FDA Order of Payment instead of relying on old fee tables copied by third-party websites.

Step 5: Pay only through the authorized FDA payment channel

Follow the current payment instructions attached to the Order of Payment. FDA lists authorized options in its eServices guidance, including designated Landbank and supported online payment channels. Keep the payment confirmation and application reference number.

Step 6: Monitor status and respond to compliance requests

The FDA eServices Portal has an Application Status function. Enter the application reference number and complete the email verification step to view progress. If FDA requests additional documents or compliance, submit them using the official facility indicated for the application.

An online application does not remove FDA inspection authority. Administrative Order No. 2024-0015 and implementing issuances provide for licensing requirements and regulatory inspection of covered health-product establishments. Whether a pre-licensing inspection is required depends on the establishment and applicable rules.

After approval

FDA marketing authorizations are delivered electronically through the registered email and/or made available through the official system. The FDA eServices FAQ states that establishments are responsible for printing the LTO; the agency no longer needs to send a hard-copy LTO through the mail for the eServices process.

Common mistakes to avoid

  • Selecting the wrong establishment activity or product category.
  • Using an email address that the authorized person cannot access.
  • Uploading expired, unreadable, or inconsistent documents.
  • Ignoring a variation that should be reported before renewal.
  • Paying based on an old fee screenshot instead of the current FDA Order of Payment.
  • Assuming an online submission guarantees approval without regulatory evaluation or inspection.

CitizenGuide practical notes

Useful details before you continue

Selecting the correct establishment activity is critical; a wrong category can cause more delay than a missing file.

Do not use renewal to hide a change that should be filed as a variation. Keep the FDA authorization aligned with the actual establishment.

Pay only the official amount and account shown in the FDA assessment/Order of Payment.

Troubleshooting

If something goes wrong

Start with the closest issue below before creating another application or account.

FDA issued a compliance request

Answer each requested item directly, replace incomplete/expired files, and keep the application reference. Do not start a duplicate application unless FDA instructs you to do so.

I selected the wrong establishment activity

Use the official FDA correction/variation/new-application instruction applicable to the error instead of submitting misleading documents under the wrong category.

I did not receive the Order of Payment or result email

Check the registered email and spam folder, then use the official application-status facility and FDA contact channel with the application reference.

Frequently asked questions

Quick answers about this process

Do I need an account to apply through the FDA eServices Portal?

The FDA eServices FAQ states that creation of a user account is not necessary to access the public eServices application flow. Follow the verification and reference-number steps shown for your transaction.

How much is an FDA License to Operate?

The amount depends on the establishment type and the current FDA schedule of fees and charges. Use the official Order of Payment generated for the application rather than an old third-party fee table.

Can FDA still inspect the establishment after an online LTO application?

Yes. FDA licensing rules provide for inspections and continuing regulatory compliance. The type and timing of inspection depend on the establishment category and applicable FDA rules.
